These Terms of Service (the “Terms”) are a binding agreement between you and Mythrilite Inc., a Delaware corporation (“Mythrilite,” “we,” “us,” or “our”), governing your access to and use of Synonym (the “Service”), including our websites, voice interview interfaces, applications, APIs, and related software and content. Please read these Terms carefully. They contain an arbitration clause and a class action waiver in Section 20 that affect how disputes are resolved.

1Acceptance of these Terms

By creating an account, clicking “I agree,” participating in a voice interview, accessing buyer research tools, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Service.

If you are using the Service on behalf of an organization (for example, as a buyer purchasing access to research outputs), you represent that you have authority to bind that organization to these Terms and that “you” refers to both you and that organization.

2Definitions

  • “Participant” means a natural person who creates an account, conducts a voice interview, or otherwise provides personal voice or biographical content to the Service.
  • “Buyer” means a person or organization that has been authorized by Mythrilite to query, view, or otherwise access Research Outputs.
  • “Twin” means the structured representation of a Participant’s self-reported preferences, behaviors, and reasoning that is generated from interviews and persisted by the Service.
  • “Interview” means a real-time voice or text session between a Participant and the Service’s AI moderator.
  • “User Content” means audio, transcripts, text, images, brand selections, survey responses, free-text comments, and any other information you submit to or through the Service.
  • “Research Outputs” means the de-identified or pseudonymous transcripts, structured fields, Twins, summaries, and analyses we derive from User Content.

3Eligibility and Accounts

The Service is intended for adults. You may only use the Service if you are at least eighteen (18) years old and have the legal capacity to enter into a contract under the laws of your jurisdiction. The Service is not directed to children, and we do not knowingly collect information from anyone under 18. If we learn we have done so, we will delete the information.

You are responsible for the accuracy of the information you provide when registering and for keeping it current. You are responsible for all activity that occurs under your account and for safeguarding your credentials. Authentication is currently provided through our identity provider; you must comply with their reasonable requirements as well. You agree to notify us promptly at security@trysynonym.com if you suspect unauthorized access to your account.

You may not maintain more than one Participant account, share credentials, or allow another person to conduct interviews on your behalf. Each Twin must reflect a single natural person.

4Description of the Service

Synonym is a voice-first research platform. Participants select brands they shop or have an opinion about, engage in an AI-moderated voice conversation, and Mythrilite captures the resulting audio and transcript. We then derive structured fields (preferences, behaviors, reasoning, occasions, substitutes, lapses, and similar) using third-party large language model providers. Authorized Buyers may query Twins to obtain grounded answers to research questions.

The Service is offered on an evolving basis. We may add, remove, or change features, retire interview formats, modify pricing, change supported regions, or otherwise alter the Service at any time. We will use commercially reasonable efforts to give notice of material changes to active users, but we are not obligated to maintain any specific feature.

5Voice Recording and Interview Consent

By starting an interview, you expressly consent to the recording, processing, transcription, and storage of your voice and the content of your conversation with our AI moderator. You acknowledge that:

  • Your microphone audio is streamed in real time to our voice provider, which produces a transcript and a synthesized AI response.
  • We persist the resulting transcript and, where applicable, the underlying audio recording, for the retention periods described in our Privacy Policy.
  • Interviews are conducted with an AI moderator, not a human. Responses are generated by automated systems and may contain mistakes, hallucinations, or non-sequiturs.
  • You will not share information you do not wish to be recorded. You will not disclose another person’s sensitive personal information, government identifiers, financial account numbers, health information, or any non-public information you are under a duty to protect.

If your jurisdiction requires the consent of all parties to a recording, by continuing the interview you provide that consent on your own behalf. You are solely responsible for ensuring that no other person can be heard or identified in your recording without their own consent.

6License Granted to You

Subject to your compliance with these Terms, Mythrilite grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use (in the case of Participants) or for your internal business research use (in the case of Buyers), in each case solely in the manner permitted by these Terms. All rights not expressly granted are reserved.

7Your Content and License Granted to Us

You retain ownership of your User Content. However, to operate, improve, and commercialize the Service, you grant Mythrilite the following license:

  1. A worldwide, perpetual, irrevocable, royalty-free, fully paid-up, sublicensable, and transferable license to host, store, reproduce, modify, adapt, create derivative works of, publicly display, publicly perform, transmit, and otherwise use your User Content to:
    • provide, secure, and improve the Service;
    • generate transcripts, summaries, structured fields, Twins, embeddings, and other Research Outputs;
    • train, fine-tune, evaluate, and benchmark internal models that power the Service, in each case subject to the de-identification commitments in our Privacy Policy;
    • deliver Research Outputs in de-identified or pseudonymous form to Buyers, including for their internal research, product development, marketing, and strategy use;
    • publish aggregated, statistical, or otherwise de-identified insights derived from User Content for marketing, thought leadership, or scientific purposes; and
    • comply with law and enforce these Terms.
  2. You also grant Mythrilite the right to use your first name or chosen display name only in connection with a Twin when displayed to Buyers, unless you request a fully pseudonymous label via privacy@trysynonym.com.

You represent and warrant that (a) you own or have all rights necessary to grant this license; (b) your User Content does not infringe any third-party rights and does not violate any law; (c) the views and statements you provide are your own and reflect your genuine recollection or opinion; and (d) you are not being compensated by any third party (such as a brand) to provide false or biased statements.

8Buyer Access and Research Use

Buyers receive access to Research Outputs subject to a separate written agreement with Mythrilite or, in the absence of such an agreement, subject to these Terms. Buyers agree that they will:

  • use Research Outputs solely for internal research, product, marketing, and strategy purposes, and not as the sole basis for any decision that produces legal or similarly significant effects on a natural person;
  • not attempt to re-identify, contact, or single out any Participant, and not combine Research Outputs with other data sets for the purpose of re-identification;
  • not redistribute, sublicense, resell, scrape, or publicly post Research Outputs outside the Buyer’s organization, except with our prior written consent;
  • not use Research Outputs to train any machine learning model not owned and operated by Mythrilite; and
  • comply with all applicable laws, including consumer protection, market research, and privacy laws.

Buyers are responsible for any use they make of Research Outputs. Mythrilite makes no representation that Research Outputs are representative of any population, are statistically significant, or are suitable for any particular purpose.

9Compensation, Incentives, and Fees

The current version of the Service does not provide cash compensation, points, or payouts to Participants for completing interviews. If we introduce compensation, incentives, sweepstakes, or referral payments in the future, the terms of those programs will be disclosed at the time of enrollment and may require additional tax-related information collection (such as a Form W-9 or W-8BEN). Participation in any such program will be optional.

Buyer fees, subscription plans, and seat pricing are governed by the order form or online checkout flow under which the Buyer purchased access. Except as required by law or expressly stated in writing, all fees are non-refundable, are payable in U.S. dollars, and exclude applicable taxes.

10Acceptable Use

You agree that you will not, and will not permit any third party to:

  • use the Service for any unlawful, harassing, defamatory, fraudulent, or infringing purpose;
  • impersonate any person or misrepresent your affiliation with any person or organization;
  • submit content that is sexually explicit, that depicts or solicits child sexual abuse material, that promotes violence, hate, or self-harm, or that is otherwise objectionable;
  • attempt to circumvent rate limits, content filters, abuse detection, authentication mechanisms, or other technical or security measures;
  • interfere with or disrupt the Service or the servers or networks that host it, including by submitting prompts intended to extract another user’s data, override the AI moderator’s instructions, or expose internal system prompts;
  • reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying model weights of the Service, except to the extent expressly permitted by applicable law;
  • use the Service or any output from it to develop a competing product, service, or model;
  • scrape, crawl, copy, or systematically extract content from the Service except via an interface we have expressly designated for that purpose; or
  • use the Service in violation of any export control or sanctions law.

We may, but are not obligated to, monitor use of the Service, investigate suspected violations, remove content, and suspend or terminate accounts that violate this section.

11AI Disclosures and Limitations

The Service uses large language models and real-time speech models supplied by third-party vendors. AI-generated content can be inaccurate, incomplete, biased, or out of date. Outputs are produced probabilistically and may change between sessions for identical inputs. You must independently verify any factual claim, recommendation, or extracted attribute before relying on it for any decision.

The Service is not intended to provide medical, legal, financial, tax, accounting, or other professional advice. Do not use the Service to make decisions that produce legal or similarly significant effects on a natural person, including credit, employment, housing, insurance, education, or access to government benefits.

12Intellectual Property

As between you and Mythrilite, Mythrilite and its licensors own all right, title, and interest in and to the Service, including all software, models, prompts, schemas, designs, logos, trademarks, and Research Outputs (other than User Content and the rights you retain under Section 7). No rights are granted to you in Mythrilite’s marks or in third-party marks displayed through the Service.

You may submit a copyright takedown request under the Digital Millennium Copyright Act by sending the required information to dmca@trysynonym.com. Misrepresentations in a takedown notice may subject you to liability.

13Feedback

If you provide suggestions, ideas, bug reports, or other feedback about the Service (“Feedback”), you grant Mythrilite a worldwide, perpetual, irrevocable, royalty-free license to use the Feedback for any purpose without obligation to you. We are free to use, disclose, reproduce, license, and otherwise exploit Feedback without restriction.

14Third-Party Services

The Service relies on infrastructure and tooling provided by third parties (for example, hosting, identity, voice, language model, database, storage, observability, and rate-limiting providers). Your use of these third-party services through the Service is also subject to their terms. Mythrilite does not control and is not responsible for the availability, accuracy, or content of third-party services or for any acts or omissions of those providers, except to the extent set out in our Privacy Policy and applicable data processing agreements.

15Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that Mythrilite will process your personal information in accordance with that policy and applicable law.

16Suspension and Termination

You may stop using the Service at any time. You may delete your account by following the in-product flow or by emailing privacy@trysynonym.com. Deletion is processed in accordance with our Privacy Policy and may be subject to legitimate retention obligations.

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe that (a) you have violated these Terms or our acceptable use rules, (b) your use creates risk or legal exposure for Mythrilite, our Participants, or our Buyers, (c) your account has been inactive for an extended period, or (d) we discontinue the Service or a feature you use.

Sections that by their nature should survive termination will survive, including Sections 7 (license to us), 12 (intellectual property), 13 (feedback), 17 (disclaimers), 18 (limitation of liability), 19 (indemnification), 20 (disputes), 21 (governing law), and 24 (general).

17Disclaimer of Warranties

The Service is provided “as is” and “as available,” with all faults and without warranty of any kind. To the maximum extent permitted by law, Mythrilite and its affiliates, licensors, and suppliers disclaim all warranties, express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted or error-free operation, security, and any warranties arising from course of dealing or trade usage.

Without limiting the foregoing, Mythrilite does not warrant that AI-generated content will be accurate, that interviews will reach any particular quality threshold, that Research Outputs will be representative of any population, or that the Service will operate without delay, interruption, or data loss. You assume the entire risk of relying on the Service.

18Limitation of Liability

To the maximum extent permitted by law, in no event will Mythrilite, its affiliates, or any of their officers, directors, employees, agents, licensors, or suppliers be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to these Terms or the Service, even if Mythrilite has been advised of the possibility of such damages.

To the maximum extent permitted by law, the total aggregate liability of Mythrilite and its affiliates arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amounts you paid to Mythrilite in the twelve months preceding the event giving rise to the claim or (b) one hundred U.S. dollars ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, Mythrilite’s liability is limited to the smallest extent permitted by law.

19Indemnification

You agree to defend, indemnify, and hold harmless Mythrilite, its affiliates, and each of their respective officers, directors, employees, agents, licensors, and suppliers from and against all claims, demands, actions, losses, liabilities, damages, judgments, fines, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to (a) your User Content, (b) your use of the Service, (c) your violation of these Terms, (d) your violation of any law or any third-party right, including any intellectual property, publicity, or privacy right, and (e) any dispute between you and a third party arising from your use of the Service.

20Disputes, Arbitration, and Class Waiver

Please read this section carefully. It affects your rights.

  1. Informal resolution. Before filing a claim, you agree to try in good faith to resolve the dispute by sending a written notice describing the dispute and the relief sought to legal@trysynonym.com. The parties will attempt to resolve the dispute by negotiation for at least sixty (60) days before initiating arbitration.
  2. Binding arbitration. Except as set out below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules in effect at the time. The seat of arbitration will be the County of New York, New York, and the arbitration will be conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.
  3. Class action waiver.You and Mythrilite agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative proceeding.
  4. Exceptions. Either party may bring an individual action in small claims court if the claim qualifies, or seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
  5. Opt out. You may opt out of this arbitration agreement by sending written notice to legal@trysynonym.com within thirty (30) days of first accepting these Terms. The notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out. Opting out will not affect any other provision of these Terms.

21Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Subject to Section 20, the parties submit to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware, for any action not subject to arbitration.

22Export, Sanctions, and Government Use

You represent that you are not located in, and are not a national or resident of, any country subject to a comprehensive U.S. embargo and that you are not listed on any U.S. government list of prohibited or restricted parties. You will not use, export, or re-export the Service in violation of U.S. or other applicable export control laws.

The Service and any related documentation are “commercial items” as defined in 48 C.F.R. § 2.101. If you are a U.S. federal government end user, your rights are limited to those granted to all other end users under these Terms.

23Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms with a new “Last updated” date and, where appropriate, by emailing the address associated with your account or surfacing an in-product notice. Changes become effective when posted unless a later effective date is stated. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

24General Provisions

  • Entire agreement. These Terms, together with the Privacy Policy and any order form or written agreement signed by Mythrilite, constitute the entire agreement between the parties and supersede all prior or contemporaneous understandings on the subject.
  • Severability. If any provision is held unenforceable, the remaining provisions will remain in full force and effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
  • No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, or sale of assets, or by operation of law.
  • Force majeure. Mythrilite is not liable for any delay or failure to perform caused by events beyond its reasonable control, including acts of God, war, terrorism, civil unrest, labor disputes, internet or utility outages, or actions of governmental authorities.
  • Notices. Notices to Mythrilite must be sent to legal@trysynonym.com. Notices to you may be sent to the email address associated with your account or posted in the Service.
  • Independent contractors. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship.
